Judgment
Instant Writ Petition has been filed under Article 226 of the Constitution of India seeking the following relief:
“to issue a Writ of Mandamus or any other appropriate writ, order or direction, more particularly one in the nature of Mandamus declaring the action of the respondents in not registering a crime against unofficial respondents and not conducting enquiry basing on my complaint Dt.03.07.2026 as illegal, irregular, arbitrary and violation provisions of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 and also offends Articles 14 and 21 of Constitution of India and consequently direct the 5th Respondent to register crime against unofficial respondents basing on my complaint Dt.03.07.2026 and to pass”.
Conspectus of facts in the present Writ Petition is that, despite the petitioner’s complaint to the police personnel, the respondent police are not acting upon the same by registering an FIR, thereby lodging criminal proceedings
Learned Assistant Government Pleader for Home basing on the Written Instructions dated 15.09.2026 of the Sub-Inspector of Police, Gopalapuram Police Station, East Godavari District submits that basing on the petitioner's complaint, police registered FIR in Crime No.122 of 2026 of Gopalapuram Police Station, East Godavari District and the investigation is going on.
At that juncture, learned counsel for the petitioner has not disputed the factum of registration of FIR.
Recording the submission made by learned Assistant Government Pleader for Home, the Writ Petition is closed. No order as to costs.
Interlocutory applications, if any, pending shall stand closed.
