Judgment
This writ petition is filed seeking a declaration that the issuance of NBWs dated 15.04.2019 in C.C.No.118/2018 on the file of XV Additional Chief Metropolitan Magistrate, Hyderabad and the issuance notice of impounding of passport as illegal and arbitrary. However, subsequently the same has been amended by seeking a declaration that the action of respondent No.3 in issuing notice No.SB2074729495522 for impounding of passport due to pendency of the matrimonial criminal proceedings along with Non Bailable Warrant dated 15.04.2019 in C.C.No.118 of 2018 on the file of the NV Additional Chief Metropolitan Magistrate, Hyderabad, as illegal and arbitrary and to pass such other order or orders.
Learned counsel for the petitioner submits that subsequent to the amendment of prayer, the criminal case has been compounded and compromised before the Lok Adalat on 28.01.2026 and the copy of the award passed under Section 21 of the Legal Services Authority Act is filed before this Court and also the case status of C.C.No.1.8 of 2018 is also filed wherein it is stated that the docket order dated 28.03.2026 recording that the defacto complainant was present and the application filed by the prosecution under Section 321 of the Code of Criminal Procedure to delete Sections 4 and 6 of Dowry Prohibition Act is allowed in Crl.M.P.No.387 2026 and the petitioner filed under Section 380(2) of Cr.P.C. to compound the offence Under Section 498(A) of IPC is also allowed and that the accused No.1 is acquitted for the said offence under Section 320(8) of Cr.P.C. Therefore, according to him, since the criminal case has been closed against the petitioner, the respondent No.4 should be directed to close the LOC against the petitioner to enable him to pursue his livelihood abroad.
Having regard to the relevant documents being filed, the respondent No.4 is directed to consider the issue, verify the contentions of the petitioner as stated herein and issue appropriate direction for closure of LOC at the earliest, preferably within a period of One (1) week from the verification of the details.
Accordingly, this writ petition is disposed of. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this writ petition, shall stand closed.
