Judgment
Alok Mahra, J
Applicant Shahnawaz, who is in judicial custody in connection with FIR/Case Crime No. 482 of 2024, under Section 29 r/w Section 8/21 of NDPS Act, 1985, registered at P.S.- Kashipur, District Udham Singh Nagar, has sought his release on bail.
Learned counsel for the applicant/accused would submit that the applicant is innocent and has been falsely implicated in the instant crime; that, the applicant/accused is not named in the FIR; that, the co-accused Faizan @ Anupam has already been granted bail by this Court vide order dated 06.11.2025 and the applicant/accused is also entitled to be released on bail on the basis of parity.
Learned counsel appearing for the State would fairly admit that it is a case of parity.
In view of the above, but, without expressing any opinion about merits of the case before the Trial Court, this Court is of the view that this is a fit case for bail on the ground of parity.
The bail application is thus, allowed and the applicant is directed to be released on bail on his executing a personal bond and furnishing two reliable sureties, each of the like amount, to the satisfaction of the Court concerned.
