Applicant Jeevan Arya @ Jaggu, who is in judicial custody in connection with FIR/Case Crime No. 05of 2025, under Section 8/20 of NDPS Act, 1985, registered at P.S.- Bhatrojkhan, District Almora, has sought his release on bail.

Learned counsel for the applicant/accused would submit that the applicant is innocent and has been falsely implicated in the instant crime; that, the co-accused, namely, Rohit Kumar and Bhupesh Kumar have already been granted bail by this Court vide order dated 15.10.2025 and the applicant/accused is also entitled to be released on bail on the basis of parity.

Learned counsel appearing for the State would fairly admit that it is a case of parity.

In view of the above, but, without expressing any opinion about merits of the case before the Trial Court, this Court is of the view that this is a fit case for bail on the ground of parity.

The bail application is thus, allowed and the applicant is directed to be released on bail on his executing a personal bond and furnishing two reliable sureties, each of the like amount, to the satisfaction of the Court concerned with the following conditions.

I) He shall attend the Trial Court regularly, and, he will not seek any unnecessary adjournment.

II) He shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of this case.

III) He shall not leave India without any prior permission of the Trial Court.

It is clarified that if the applicant misuses or violates any of the conditions, imposed upon him, the complainant/informant will be free to move the court for cancellation of bail.
