The above original petition is filed seeking a direction to the Wakf Board to consider and pass orders in Ext.P3 IA filed by the petitioner in OP No.26 of 2023 pending before it.
Pursuant to our orders dated 1.3.2023 and 8.3.2023, Board has passed orders on Ext P3 application on 8.3.2023, which is made available before us for perusal. As per the said order, the Returning Officer was directed to include the name of the petitioner in the voter's list and permit him to contest the election if he clears his due of Rs.75,070/- which is certified by the auditor as to be recouped from him on or before 11.3.2023. Since we are told that the last date for nomination is 13.3.2023, taking into account the urgency of the situation, we permit the petitioner to deposit Rs.75,070/- before the Wakf Board before 11-3-2023, in which event the same shall be treated as compliance with the Board order dated 8-3-2023 so as to enable him to contest the election as directed in the said order. This, however, will not prevent the petitioner or the contesting respondents from challenging the directions in the order of the Wakf Board dated 8.3.2023 in appropriate proceedings. Leaving open the said right, the original petition is disposed of.
