This Chamber Appeal is to impugn the order dated 10.03.2026 passed by the Registrar of this Tribunal whereby the Misc. Appeal (Dy.) No.1709/2025 filed by the appellant was declined to be registered due to the failure of the appellant to cure the defects pointed out by the Registry.
The appellant had filed Misc. Appeal (Dy.) No.1709/2025 aggrieved against the order dated 11.08.2025 passed by DRT-II, Delhi in TSA No.700/2022 titled as Mrs.Satinder Kaur Ahuja & another V. Karnataka Bank & another on 26.09.2025 through e-filing. The Registry raised an objection that the hard copy of the appeal was not filed by the appellant and listed the matter before the Registrar on 06.02.2026 for rectification of the defects. None appeared on behalf of the appellant before the Registrar on the said date and the Registrar adjourned the matter to 16.02.2026 while giving a final chance to the appellant to rectify the defect. On 16.02.2026 also none appeared and the matter was adjourned to 10.03.2026 for removal of defects. Again, on 10.03.2026 when no one appeared for the appellant for rectifying the defect before him the Registrar under Rule 6(4) of the Debts Recovery Tribunal (Procedure) Rules, 1993 declined the registration of the appeal.
It is stated in the Chamber Appeal that counsel for the appellant was not aware of the listing of the matter for curing the defects before the Registrar on different dates as he was not informed of the listing of the matter and therefore he could not appear before the Registrar on those dates. It is also stated that the counsel was taking care of his mother who had undergone a surgery and his ailing father for a while and therefore could not follow up the matter before this Tribunal.
Taking into consideration all the facts, this Chamber Appeal No.04/2026 is allowed and the appellant is directed to cure the defects as pointed out by the Registry in the Misc. Appeal (Dy.) No.1709/2025 within two weeks from today.
