The appellant purportedly filed Appeal bearing (EDRAT) No.724/2025 on 13.05.2025 to impugn the order dated 10.03.2025 passed by DRT-II, Delhi in S.A. bearing T.S.A. No.354/2023 titled as M/s LPR Company Private Limited & another v Pegasus Assets Reconstruction Private Limited & others, whereby the TSA was dismissed. However, the appellant has not uploaded requisite supporting documents as per rules, except paying a fee of Rs.250/- and due to this reason, the purported appeal could not be scrutinised. The matter was listed before the Registrar on 25.08.2025 and 01.09.2025 but none appeared on behalf of the appellant on both dates. Consequently, the Registrar of this Tribunal under Rule (4) of the Rules, declined to register the same vide order dated 01.09.2025. Aggrieved, the appellant has filed the present Chamber Appeal impugning the order dated 01.09.2025 passed by the Registrar.

It is stated in the Chamber Appeal that the subsequent to the filing of the Appeal bearing (EDRAT) No.724/2025 the appellant had also deposited a fee of Rs.1 lac on 14.05.2025 but due to some reason the PDF file of the appeal did not get uploaded. It is further stated that on coming to know that the appeal filed by the appellant was defective, the Registry of this Tribunal was contacted and e-filing of the appeal along with documents was again done and hard copy of the appeal paper book was also filed. It is stated that non-appearance on 25.08.2025 and 01.09.2025 before the Registrar was neither intentional nor deliberate but was under bona fide belief that the appeal would be listed in daily cause list. It is prayed that the order dated 01.09.2025 passed by the Registrar may be set aside and the Appeal bearing (EDRAT) No.724/2025 be restored to its original number

After considering all facts, the order dated 01.09.2025 passed by the Registrar is set aside and the Appeal bearing (EDRAT) No. 724/2025 is restored to its original number. Registry to scrutinize the appeal and place before the Registrar on 27.07.2026 for further proceedings and appropriate directions.

Chamber Appeal bearing no.08/2026 stands disposed of.
