There is no representation for the petitioner. Heard Mr. T.S. Phartiyal, Additional Chief Standing Counsel and Mr. Pradeep Hairiya, learned
Standing Counsel appearing for the State of Uttarakhand/respondents through video conferencing.
By means of this writ petition, petitioner has sought the following reliefs:-
(i) Issue a writ, order or direction in the nature of certiorari for quashing or setting aside of order dated 11.02.2021 passed by Mela Adhikari, Kumbh
Mela Haridwar, denying the allotment of land to the petitioner to provide facilities of tent to female sadhvis and all other facilities including Shahi Snan
during Ardhkumbh Mela scheduled to be held in the year 2021 in Haridwar.
(ii) Issue a writ, order or direction in the nature of mandamus directing the respondents for granting entire facilities to the petitioner society (i.e. the
same facilities as being provided to the male sadhus/Akharas) at Melasthal including Shahi Snan during the forthcoming 2021 Kumbh Mela, Haridwar
during the pendency of this writ petition.
Petitioner had requested for allotment of tents for female sadhvis and other facilities during Ardhkumbh Mela scheduled to be held in the year 2021.
Petitioner’s request was turned down by Melaadhikari Haridwar, Kumbh Mela, 2021, vide order dated 11.02.2021, on the ground that in view of
the directions issued by the Central Government, it would not be possible to provide tents to private bodies/individuals.
Mr. T.S. Phartiyal, learned Addl. C.S.C. appearing for the State of Uttarakhand/respondents submits that the writ petition has become infructuous
as the Kumbh Mela, 2021 is over, long back.
This Court finds substance in the submission made by learned Government Pleader. After conclusion of Kumbh Mela, 2021, the relief as claimed in
the writ petition, does not survive. Accordingly, the writ petition is dismissed as infructuous.
