According to the petitioner-company, it was issued work order for constructing and maintaining 20 smart toilets within the limits of Nagar Nigam, Haridwar. However, petitioner-company has been allotted only 07 sites and, 07 smart toilets were constructed and handed over to the Nagar Nigam, Haridwar.

By means of this writ petition, the petitioner has sought a direction to the Nagar Nigam to make available the remaining sites or to provide some alternate sites where smart toilets could be constructed.

Mr. Sandeep Kothari, learned counsel appearing for Nagar Nigam, Haridwar submits that the land over which smart toilets have to be constructed belongs to various departments of the State Government; he submits that because of the Kumbh Mela, which is scheduled to be held in January-February 2027, various aspects have to be considered, particularly, the safety, security of pilgrims visiting Kumbh Mela and, the resultant crowd management, therefore there cannot be any constructions raised on the sensitive area near banks of river Ganga. He further submits that if petitioner makes a representation to the competent authority in Nagar Nigam, Haridwar, the same shall be dealt with as per law.

The writ petition stands disposed of accordingly with liberty to the petitioner-company to make fresh representation to the competent authority in the Nagar Nigam. If the petitioner-company makes such representation within 10 days from today, the competent authority is directed to take decision on the same, as per law, within two months thereafter.
