Judgment
Heard the learned counsel for the parties.
The petitioner has approached this Court for a direction to the District Magistrate, Bettiah for disposal of her representation which was filed on 11.12.2018 against the order dated 24.11.2018 passed by the District Programme Officer, West Champaran, Bettiah.
It appears that the petitioner was working at Aanganwari Centre No. 33 which was being conducted from Ward No. 10. Later, on the complaint of others who along with the petitioner wanted the same to be conducted from Ward No. 10, made an application before the District Programme Officer, West Champaran, Bettiah for the needful. It was found by the District Programme Officer vide his order dated 24.11.2018 that the petitioner though was Aanganwari Sevika at Aanganwari Centre No. 33 which is being conducted from Ward No. 13, but the petitioner and another are insisting that the centre be shifted to Ward No. 10. The District Programme Officer, West Champaran, Bettiah vide his order dated 24.11.2018 referred to above has noted that the petitioner wants to run the centre from Ward No. 10. It has therefore been ordered that for the centre of Ward No. 10, fresh selection process be initiated forthwith. The petitioner has been directed to run the Centre No. 33 from Ward No. 13 which was being run from before.
Learned counsel for the petitioner submits that the observation of the District Programme Officer, West Champaran, Bettiah that the petitioner is rigid for conducting the Aanganwari centre from Ward No. 10 is not correct. A request only had been made by the petitioner and another Aanganwari Sevika to conduct the centre from Ward No. 10, which request has been rejected by the District Programme Officer, West Champaran, Bettiah.
Under the aforesaid circumstances, the District Magistrate, West Champaran, Bettiah is directed to dispose of the representation of the petitioner filed on 11.12.2018 within a period of four weeks from the date of receipt/production of a copy of this order. While passing a reasoned order, the District Magistrate, West Champaran, Bettiah shall give primacy to the place from where the centre ought to be conducted, the purpose behind running such centre being the benefit of women and children of the aforesaid locality.
With the aforesaid direction/observation, the writ petition is disposed of.
