Vide order dated 31.01.2024, the Registrar (Vigilance) of this Court was directed to make an enquiry and submit a report to this Court within a week with regard to supply of incomplete FIR. Pursuant to that, the report has been submitted and it has come in the report that incomplete FIR has been transmitted by the police and accepting that report vide order dated 13.02.2024, the Superintendent of Police, Gumla was directed to file the affidavit as to why the entire document was not transmitted to the learned Court where the matter is pending. Pursuant to that, the Superintendent of Police, Gumla has filed the affidavit, wherein, he has stated that he has authorized the Deputy Superintendent of Police (HQ), Gumla to investigate and submit report vide letter dated 15.02.2024. The Deputy Superintendent of Police (HQ), Gumla has submitted detailed enquiry report vide letter dated 17.02.2024, wherein, it is stated that complete FIR had been submitted in original to the learned Court of the Chief Judicial Magistrate, Gumla on 13.12.2011 without any objection. The enquiry report and receiving of the Court are contained in Annexure-B series of the counter affidavit filed by the Superintendent of Police, Gumla.

It is strange if FIR was received on 13.12.2011 itself, how the report has been provided to this Court by the concerned Court that incomplete FIR was received by the concerned Court.

In that view of the matter, the Principal District and Sessions Judge, Gumla will further enquire into the matter and send a report to this Court within two weeks.

The Registrar General of this Court shall provide photocopy of the affidavit filed by the Superintendent of Police, Gumla along with annexures to the learned Principal District and Sessions Judge, Gumla for proper enquiry.

In the meantime, the petitioner is at liberty to obtain certified copy of the complete FIR and file the same.

Let this matter appear on 19.03.2024.

7.

Interim order, granted earlier, shall remain in force till the next date.
