The present misc. application has been filed by the petitioner for releasing the petitioner from the Jail and to modify the order dated 21.10.2019 passed in S.B. Criminal Revision Petition No.1027/2018, by which this Court has allowed the revision petition and directed the petitioner to deposit 15% of the Cheque amount before the Rajasthan State Legal Services Authority, Jodhpur.

Learned counsel for the petitioner submits that the compromise has arrived between the parties and the petitioner has been acquitted but vide order dated 21.10.2019 passed by this Court in S.B. Criminal Revision Petition No.1027/2018 it is directed to the petitioner that 15% of the cheque amount shall be deposited before the Rajasthan State Legal Services Authority, Jodhpur. Counsel further submits that the petitioner is a poor person and he is not in a condition to deposit the said amount. Therefore, the condition may kindly be waived.

Learned Public Prosecutor and counsel for the respondent No.2 opposed the prayer made by the counsel for the petitioner.

I have considered the arguments advanced before me and perused the material available on record. Petitioner is behind the bars since 02.08.2023 and the order in S.B. Criminal Revision Petition No.1027/2018 has been passed on 21.10.2019. Therefore, it is directed that if the petitioner comply with the order dated 21.10.2019 and deposits 15% of the cheque amount before the Rajasthan State Legal Services Authority, Jodhpur within a period of fifteen days from today then the petitioner shall be released from the Jail.

The application is disposed of accordingly.
