Judgment
On advance notice, Shri V.S. Tomar, Advocate appears for the respondents.
Having heard learned counsel for both the parties, we find that the Statutory Complaint filed by the applicant vide Annexure-A 1 on 26.03.2020 is
still pending with the Competent Authority at the Army Headquarters and the same has not yet been decided.
Considering the fact that the prayer made before us at the time of hearing by Shri Chhibber was for a direction to the respondents to decide his
Statutory Complaint at an earlier date, in accordance with law, we see no reason to deny the aforesaid prayer.
Accordingly, we allow this application and dispose of the matter with the following directions :
On the applicant's filing a certified copy of the order along with copies of the relevant documents before the Competent Authority at
Army HQ, the Competent Authority shall decide the Statutory Complaint, in accordance with law, within a period of thirty (30) days
from the date of receipt of copy of the order and indicate the decision so taken to the applicant.
With the aforesaid, the OA stands disposed of. Copy of this order be given `Dasti'.
