The applicant states that she is working as Senior Superintendent in PB-3 with Grade Pay of Rs.6600 for the past 11 years in the service of the Government of NCT of Delhi. Her grievance is that though she became ripe for promotion to the post of Joint Director (Technical) in the Department of Social Welfare, her case is not being considered. The applicant contends that earlier, the case of one Mr. M.K. Sharma was considered for promotion to that post and it did not fructify on account of pendency of a criminal case against him. He contends that there is absolutely no basis for the respondents in not considering her case.

We heard Shri Yogesh Sharma, learned counsel for the applicant and Shri N.D. Kaushik, learned counsel for the respondents at the admission stage.

The applicant contends that as of now there are no rules governing the promotion to the post of Joint Director and in a way, the applicant made a prayer for a direction to the respondents to frame the rules. We cannot enter into that field at all. It is for the respondents to decide whether or not to frame the set of rules.

In case there exists a vacancy in the post of Joint Director (Technical) and the applicant is otherwise eligible, the respondents need to consider her case. If there exist any reasons for not considering the case of the applicant, they need to be communicated. The representation made by the applicant in this behalf on 04.12.2018 cannot be kept pending indefinitely.

Hence, we dispose of the OA, directing the respondents to pass the order on the representation dated 04.12.2018 within a period of six weeks from the date of receipt of a copy of this order. There shall be no order as to costs.
