Heard Mr. Gagan Deo Yadav, learned Advocate for the petitioner and learned Advocate for the State.

The challenge in the present writ petitioner is made to the order contained in Memo No. 2107 dated 18.11.2025 passed in Miscellaneous Case No. 02/2025 by the District Programme Officer (I.C.D.S.), whereby and whereunder the appeal filed by the petitioner has been rejected.

Learned Advocate for the petitioner while assailing the impugned order has made various submissions, however, he fairly submitted that earlier against the action of respondents in issuing the appointment letter in favour of the respondent no. 7, the petitioner has approached before the District Programme Officer and letter on preferred an appeal on being dissatisfied with the order of the District Programme Officer before the learned Collector, Madhubani, who upon hearing the parties, vide its order dated 22.10.2024, remanded the matter to the District Programme Officer.

Considering the submissions advanced and taking note of the fact that the petitioner is prima facie aggrieved with the order passed by the District Programme Officer (I.C.D.S.), which is appealable before the concerned District Magistrate, this Court deems it fit and proper to dispose off the writ petition with a direction to the petitioner to avail the remedy of appeal before the District Magistrate. In case the petitioner files an appeal, preferably within a period of four weeks from today, the concerned District Magistrate shall consider the same and pass necessary order in accordance with the rules/schemes, which is applicable to the case of the petitioner.

The writ petition stands disposed.
