2.

This is a case of girl running away from the home for the sake of her lover viz., Syed Ali Shabbir, who filed impleadment petition WPMP No.31617 of 1998. We held conciliation proceedings in-camera on several dates i.e., 3-8-1998, 10-8-1998, 24-8-1998 and also today i.e., 18-9-1998. We have questioned the petitioner-M Sonu, her mother, maternal uncle and maternal uncle''s wife as also Syed Ali Shabbir in the presence of their respective Counsel. We have also called for a report about Syed Ali Shabbir by requesting the learned Public Prosecutor, who presented the same. Apart from the learned Public Prosecutor, the learned Government Pleader was also present. The girl is so adamant that she does not want to go with her parents and has shown so much of aversion towards them. Repeatedly she told that she wants to marry Syed Ali Shabbir. We have even tried to provide security to her, and Mr. Syed Ali Shabbir was ready to provide the same either in terms of cash or in terms of property. But the girl says she has fullest confidence in Syed Ali Shabbir and she does not want any kind of security. Now admittedly, the petitioner is a major. She is a free citizen of the country and she is entitled to move freely and have the free choice to go to any place and to marry anybody. There is no doubt that she is in so much love with Syed Ali Shabbir, and she wants to accompany him now itself. Therefore, we have got no choice but to let her free as she is a major, and there are no legal reasons to impose any fetters in her being let fee at once.

3.

Under the circumstances, the petitioner is now freed from any kind of detention. The police officers are now freed from their responsibility. The girl now need not be sent back either to Rescue Home or Manila Rakshak Samithi in view of what is stated supra.

4.

The writ petition is disposed of as above. No order as to costs.
