Heard Mr. D. Hynniewta, learned counsel for the petitioners.
Issue notice.
The respondent No. 1 is represented by Mr. S. Sen, learned Standing counsel NEHU University and the respondent No. 3 by Mr. N.D. Chullai, learned AAG assisted by Mr. E.R. Chyne, learned GA, so no further notice is required upon these respondents.
Notice to issue to respondent No. 2.
The grievance of the writ petitioner is that she has not been able to submit her examination form and examination fees in order to sit for the BA 5th Semester examination in the respondent No. 2 college due to shortage of attendance caused by illness, for which Medical Certificates have been appended at Annexures – III, IV and V, showing the nature of her illness.
It has been submitted by Mr. D. Hynniewta, learned counsel for the petitioner that no order of rejection of her examination form has been given by the college, but only that she has not been allowed to submit the same.
Mr. S. Sen, learned counsel appearing for the respondent No. 1 has submitted that the conduct of the examination is under the respondent No. 1 NEHU, but for the candidates to be able to sit for the examinations, the same is within the jurisdiction of the college, who forwards the necessary application to the University.
Considering the case of the petitioner who has not obtained the necessary percentage of attendance due to illness, but as the St. Dominic College, Dum Dum, Nongthymmai, Shillong is not represented today, due to the urgency as the exams are to commence from the 18th November, 2024, the counsel for the petitioner to effect personal service upon to the respondent No. 2 and the case be listed tomorrow at 10:30 AM in the motion column.
