The petitioner has approached this Court seeking a direction upon the concerned respondents to consider and grant promotion to the petitioner on the post of Headmaster from the date he fulfills the eligibility criteria as per Rule 8 of the Bihar Zila Parishad/Nagar Nikay Secondary and Senior Secondary School Service (Appointment, Promotion, Transfer, Disciplinary Proceedings and Service Conditions) Rules, 2020 (in short ‘Rules, 2020’). It is submitted that for redressal of identical grievance seeking promotion to the post of Headmaster, some of the identically situated persons had approached this Court in CWJC No. 16951 of 2024 and they have been extended the liberty to approach before the Deputy Development Commissioner-cum-Chief Executive Officer, Zila Parishad. The petitioner also submitted that for redressal of the grievance, he also filed a representation which may be disposed off in terms with Rules 7 and 8 of the Rules, 2020.

Mr. Prince, learned Advocate for the Zila Parishad interjected and submitted that at the time of consideration of the claim of the petitioner, the prescription provided under Bihar State Senior Secondary School Headmaster (Appointment, Promotion, Transfer, Disciplinary Proceedings and Service Conditions) Rules, 2021 is also required to be looked into.

Considering the limited prayer of the petitioner that for redressal of the grievance, the petitioner has already filed a detailed representation before the Deputy Development Commissioner-cum-Chief Executive Officer, Zila Parishad, West Champaran, Bettiah, copy of which is marked as Annexure-12 to the writ petition, this Court, instead of keeping the matter pending, deems it fit and proper to dispose off the present writ petition with a direction to the concerned respondent no. 7 to look into the representation of the petitioner, as referred hereinabove and bring to its logical conclusion by reasoned and speaking order, preferably within a period of 8 weeks from the date of receipt/production of a copy of this order.

The writ petition stands disposed off.
