Judgment
Heard Gurram Venkat Ramana, learned counsel for the petitioner; Mr. M.Sahas Reddy, learned Assistant Government Pleader for Revenue, appearing for respondents No.2 to 4; Mr. Kanchani Laxmaiah, learned Standing Counsel for respondent No.5; and perused the material on record.
The case of the petitioner is that respondents No.2 to 5 are interfering with his possession and enjoyment of the subject property admeasuring bearing Plot No.A-8, admeasuring 476.66 square yards in Survey Nos.40/Part, 41, 43/छ, छ, २, 43/2, 44/छ, छ, २, 50, 51, 52/छ, छ, २, ५, 53/1, 54, 55, 56/छ, २, 57/२, 103/P, 103/छ, २, 104, 105/छ, छ, situated at Manikonda Jagir Village, Gandipet Mandal, Ranga Reddy District, without following due process of law.
It is submitted that the petitioner is the absolute owner and possessor of the subject property having purchased from Ms. Kondala Susheela under registered agreement of sale-cum-general power of attorney bearing document No.4009 of 2024 dated 20.04.2024. The petitioner was issued regularization proceedings No.7890/LPS/HMDA/Plg/2008 dated 26.02.2010 from the HMDA. While so, respondents No.2 to 4 started interfering with the possession and enjoyment of the petitioner in respect of the subject property, as such, the petitioner is constrained to approach this Court.
Learned Assistant Government Pleader for Revenue, basing on the written instructions, submitted that as per the revenue records, the land admeasuring Ac.0-12 guntas in Survey No.42, situated at Manikonda Jagir, Gandipet Mandal, is classified as Poramboke land and recorded as Government Land and the same is under the Government custody. The petitioner is claiming the Government land in Survey No.42 admeasuring 476.66 square yards taking advantage of the Government land in Survey No.42 being adjacent to the patta land in Survey Nos.43, 44, 41 and other survey numbers. It is further submitted that the Government has erected sign board to protect the Government land in Survey No.42. Thus, question of interfering with the possession and enjoyment of the petitioner in respect of the subject property does not arise. The petitioner, with an intention to grab the Government land, has approached this Court with unclean hands.
In the circumstances, this writ petition is disposed of directing respondents No.2 to 5 not to take any coercive steps against the petitioner without following due process of law. There shall be no order as to costs.
As a sequel thereto, miscellaneous applications, if any, pending in the writ petition, stand closed.
