Ld. Counsel for both sides are present and heard.

The instant application has been filed by the applicant challenging the impugned transfer order dated 24.10.2025(Annexure– ‘A-11’) while working as Senior Section Engineer/P.Way/AMBG(Sectional) at Arambagh under AEN/LLH, was temporarily transferred and posted as SSE/P.Way/HGY (in charge) under AEN/LLH in his same capacity of pay and level till further advise.

Though the reply has already been filed, however, Ld. Counsel for the applicant during course of hearing, has placed one transfer order dated 29.05.2026 issued by the Eastern Railway, Howrah Division, whereby one employee Sri Sudip Majumder working as SSE/P.Way/BDC(Sec) under SSE/P.Way/BDC was transferred and posted as SSE /P.Way/ HGY(Inc) under AEN/LLH in his same capacity of pay and level vice Sri Anindya Nandi. Therefore, Ld. Counsel for the applicant has submitted that since his transfer place has already been filled up by another employee, the transfer order of the applicant has become infructuous.

Let the copy of this office order be kept on record.

However, Ld. Counsel for the respondents has submitted that he is not aware regarding this transfer order.

Heard both the parties and perused the materials on record.

From the perusal of Office Order dated 29.05.2026 issued by the Eastern Railway, Howrah Division, another Senior Section Engineer employee namely Shri Sudip Majumder has already been transferred in the place of ^{posting of the applicant.}Central Administrative Tribunal

Therefore, in view of the submissions made by the Ld. Counsel for the applicant, the transfer order of the applicant has become infructuous.

Accordingly, O.A. is disposed of as infructuous with no order as to costs.
