Sanjib Kisku vs State of Jharkhand

The bail application of Sanjib Kisku in connection with Nala P.S. Case No.45 of 2020, registered for the offences under Sections 448, 269, 290, 376 of the Indian Penal Code, has been moved by Mr. Bhaiya Vishwajit Kumar, learned counsel for the petitioner and opposed by Mr. Kaushal Kishore Mishra, learned A.P.P. for the State.

The proceeding has been conducted through Video Conferencing in view of the guidelines of the High Court taking into account the situation arising due to COVID-19 pandemic.

Mr. Bhaiya Vishwajit Kumar, learned counsel for the petitioner submits that the case has been lodged by the husband of victim. He submits that victim is working as cook in the school whereas the petitioner is Para Teacher. He further submits that in the statement recorded under Section 164 of the Code of Criminal Procedure victim has stated nothing and the case has been falsely lodged by husband of victim against the petitioner. This fact has also come in the memo of evidence. He also submits that the petitioner is in jail custody since 12.05.2020.

Regard being had to the attending facts and circumstances, I am inclined to enlarge the above named petitioner on bail, on furnishing bail bond of Rs10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamtara in connection with Nala P.S. Case No.45 of 2020.
