Judgment

The petitioner seeks regular bail in FIR No.366/2020, dated 20.12.2020, registered under Sections 20 & 29 of the Narcotics Drugs and Psychotropic Substances Act, 1985 at Police Station Sadar, District Kullu, H.P.
Respondent has filed status report and also produced the record.
Learned Additional Advocate General submitted that the prosecution in all has 21 witnesses in support of its case against the petitioner. Out of them, 12 witnesses have already been examined. 9 witnesses remain to be examined, out of which, 7 are police officials and 2 material witnesses are scheduled for examination on 1.6.2023.
Since examination of 2 material witnesses is scheduled on 1.6.2023 before the learned Trial Court, therefore, learned counsel for the petitioner submitted that he would not press this petition at this stage. However, liberty may be granted to the petitioner to move fresh petition, in accordance with law, at an appropriate stage. Prayer is accepted. Accordingly, the petition stands dismissed as withdrawn with leave and liberty as prayed for. Pending miscellaneous application(s), if any, shall also stand disposed of.
