The petitioner seeks regular bail in FIR No.2/2021, dated 01.01.2021, registered under Section 22 of the Narcotic Drugs and Psychotropic Substances Act, 1985 at Police Station Paonta Sahib, District Sirmour, H.P.
The FIR pertains to alleged recovery of commercial quantity of psychotropic substances from the petitioner.
The respondent has filed the status report and also produced the record.
Learned Additional Advocate General stated that out of total 15 prosecution witnesses, 11 have already been examined. Only four witnesses remain to be examined and the matter for that purpose is listed before the learned Trial Court on 12.07.2023.
Faced with this, learned Senior Counsel for the petitioner sought permission to withdraw the present petition with liberty to file afresh at an appropriate stage in accordance with law. Prayer is not opposed. Accordingly, the present petition is dismissed as withdrawn with leave and liberty as aforesaid. Pending miscellaneous application(s), if any, also stand disposed of.
