Judgment
Per: Mr. Anindo Majumdar, Administrative Member.
The applicant has approached this Tribunal under Section 19 of the Administrative Tribunals Act 1985, praying for the following relief(s):-
“a)To set aside and / or quash transfer order dated 09.05.2026 issued by the Bharat Sanchar Nigam Limited, BSNL Corporate Office bearing no. BSNL CO-PETS/12(11)/1/2025-PERS1".
b)To set aside and/or quash order dated 17.09.2026 issued by the AGM (Pers-I), Bharat Sanchar Nigam Limited, BSNL Corporate Office bearing no. BSNL CO-PETS/18/3/2020-PERS1".
c)To direct the General Manager (Pers.), BSNL Corporate Office to consider the representation dated 11th May, 2026 submitted by the Applicant.
d)And/or pass any other order or orders and / or direction /directions as to this Hon'ble Tribunal may deem fit and proper.”
Ld. Counsel for both the sides are present and heard.
Ld. Counsel for the applicant files Affidavit of Service, which is taken on record.
Ld. Counsel for the respondents files memo of appearance, which is taken on record.
Ld. Counsel for the applicant submits that the applicant is a BSNL employee and has been transferred from Kolkata to Mumbai vide order dated 09.05.2026 aggrieved by the said transfer order the applicant has submitted a representation dated 11.05.2026 to the General Manager (pers) corporate office, New Delhi through proper channel seeking for the cancellation of the said transfer order.
Ld. Counsel for the applicant submits that at this stage he would be satisfied if his representation is considered sympathetically.
Ld. Counsel for the respondents vehemently objects to the prayer of the applicant.
In view of the above, the Respondent No. 02 is directed to take a decision on the pending representation of the applicant dated 11.05.2026 praying for the cancellation of his transfer order within a period of 01 months from the date of receipt of a certified copy of this order and decision so taken be communicated to the applicant by way of a reasoned and speaking order.
It is further directed till the disposal of the representation the applicant may be allowed to continue in his present post.
It is made clear that we have not gone into the merits of the case and all points are considered open.
Accordingly, the OA is disposed of. No costs.
