Judgment
(Per: HONOURABLE MR. JUSTICE SUDHIR SINGH)
Heard learned counsel for the parties.
Pursuant to the order dated 05.10.2026, learned counsel for the State has produced before this Court a Demand Draft bearing No. 074603 dated 13.10.2026 for a sum of ₹7,65,000/- (Rupees Seven Lakh Sixty Five Thousand Only), issued in favour of the petitioner.
Let a xerox copy of the said demand draft be marked as ‘X’ and made part of the record.
Let the demand draft be handed over to learned counsel for the petitioner, Mr. Raj Nandan Prasad.
It is not in dispute that the petitioner in the present contempt application, who was Respondent No. 8 in the earlier writ petition, had purchased the vehicle in question through auction-cum-sale and had got the same registered in his name. While disposing of the said writ petition, this Court directed that, if the vehicle was in possession of the petitioner therein, the same shall be returned forthwith to the auction purchaser, failing which the auction purchaser would be entitled to litigation costs quantified at ₹50,000/- payable by the petitioner therein. Since the vehicle was already in possession of the petitioner in the earlier writ petition, who is Opposite Party No. 8 herein, it continued to remain in his possession. However, following the accident, the vehicle is presently lying at the concerned Police Station.
Since the consideration amount has already been paid to the petitioner in the present contempt application by the State Government, the petitioner and Opposite Party No. 8 shall take all necessary steps for transferring the registration of the vehicle in favour of the petitioner, who is the auction purchaser, preferably within a period of eight weeks from today.
Accordingly, the present contempt application stands disposed of.
Pending application(s), if any, shall also stand disposed of.
