Sanjay Kumar vs The State of Bihar

Heard learned counsel for the petitioner, learned counsel for the State and learned counsel for the Bihar State Food and Civil Supplies Corporation.

In this case the petitioner is claiming that he is entitled to Rs.48,69,288/- for the work of supplying of food grains on door to door basis under Public Distribution System.

The facts of this case are that the petitioner was selected as a contractor and was to distribute the food grains on door to door basis under Public Distribution System. He has successfully discharged the duty and placed the demand of Rs.48,69,288/-, which has not been paid by the Bihar State Food and Civil Supplies Corporation.

Learned counsel for the Bihar State Food and Civil Supplies Corporation submits that the petitioner should approach the Deputy Chief of Transport, Bihar State Food and Civil Supplies Corporation for redressal of his grievance, who will consider the case of the petitioner and if it is found that he is entitled to the aforesaid amount, then the same will be paid to him.

In such view of the matter, let the petitioner file a proper representation before the Deputy Chief of Transport, Bihar State Food and Civil Supplies Corporation, narrating entire facts of his case. If such a representation is filed, the Deputy Chief of Transport, Bihar State Food and Civil Supplies Corporation shall consider the same and if it is found that the petitioner is entitled to the aforesaid amount, then the same will be paid to him without unnecessary delay. The entire exercise will be completed by the authority concerned within a period of two months from the date of filing of the representation by the petitioner.

With the aforesaid observations and directions, this writ application is disposed of.
