S.N. Mishra, J.—It is submitted that the petitioner was appointed on compassionate ground on class-IV post in the year 1996 since his father died while he was in service on 31.10.1994. It is submitted that the District Establishment Committee recommended the case of the petitioner for appointment on class III post, but due to non-availability of the vacant post he was appointed only on class IV post with an assurance that whenever the vacancy arises, his cane shall be considered. It is submitted that now the class III post is vacant since one employee has recently retired on 23.8.2000. It is submitted that the petitioner is a Science graduate and he accepted the class IV post only on the assurance that he will be appointed on class III post whenever the vacancy arises. It is submitted that the petitioner has already filed a representation before the Special Officer, Hazaribagh Municipality, copy of which is made Annexure-4 to this writ application. In that view of the matter, the respondent, particularly Special Officer, Hazaribagh Municipality is directed to consider the representation of the petitioner in the light of the observation made hereinabove and dispose of the same within three weeks from the date of receipt/production of a copy of this order. If the claim of the petitioner is found to be genuine, an appropriate order must be passed forthwith. This disposes of this writ application.
