Per Hon’ble Mr. Pankaj Kumar, Member-Administrative

In this case relating to old pension scheme, the applicant has sought following reliefs:-

To quash the impugned order dated 17.02.2026 (contained as Annexure No. A-1 to this OA), with all consequential benefits.

2.

To issue orders in respect of the applicant granting/treating him to be the beneficiaries of Old Pension Scheme {Railway Services (Pension) Rules 1993} and accord other ancillary benefits.

3.

Any other relief, which this Hon'ble Tribunal may deem fit, just and proper under the circumstances of the case, may also be passed.

Cost of the present case.

Heard learned counsel for the applicant, learned counsel for the respondents and perused the records.

At the outset, learned counsel for the applicant submits that ends of justice would be served if applicant is permitted to file fresh representation and the competent authority is directed to decide the same in light of the Department of Pension & Pensioners’ Welfare (DPPW) office memorandum (OM) dated 22.06.2026 and the Railway Board’s RBE No. 49/2026 dated 24.06.2026, by way of reasoned and speaking order within a reasonable period of time.

Learned counsel for the respondents opposes the aforesaid prayer; however, submits that, if so directed, at least two months’ time may be given for disposal of the said representation.

Keeping in view the innocuous prayer made by the applicant, this OA is disposed of, without going into the merits of the case, granting liberty to the applicant to submit a fresh representation mentioning necessary details to the respondents within two weeks from the date of receipt of certified copy of this order and the respondents/competent authority are directed to consider and decide the applicant’s representation in light of DPPW’s OM dated 22.06.2026 and Railway Board’s RBE No. 49/2026 dated 24.06.2026 in accordance with law by passing a reasoned and speaking order in supersession of the impugned order dated 17.02.2026 and communicate it to the applicant within a period of two months from the date of receipt of such representation.

Associated MAs also stand disposed of.

Parties shall bear their own costs.
