P. Jyothimani, J.—The Petitioner is the husband of the detenue Radha, aged about 25 years.

The Habeas Corpus Petition is filed to produce the detenue on the ground that the third Respondent has kidnapped her. At the instance of the

police, the detenue has been produced before this Court. It is informed by the learned Additional Public Prosecutor that the third Respondent has

surrendered before the Magistrate concerned and he has been remanded and criminal actions are being taken against him for kidnapping.

Today, when the detenue Radha was produced before this Court, on examination, we found that she was taken away by the third Respondent,

who was known to the brother-in-law of her husband, viz., the Petitioner and she does not remember as to how she was taken away and she has

stated that she has been placed in various areas, which she is not aware. After coming to know about the filing of Habeas Corpus Petition,

according to her, she was left in Pudukkottai.

Since the detenue expressed her willingness to go along with her husband, viz., the Petitioner, who happens to be the maternal uncle of the

detenue, who has also agreed to take her back along with her parents, who have also come to this Court, she is set at liberty.

Recording the said statement of the detenue, the Habeas Corpus Petition stands disposed of.
