Judgment
The petitioner society sought to raise a cause for adequate compensation to the dependents of the deceased Mazloom Ansari son of Md. Ibrahim Miyan, resident of village Tumartanr, P.S. Herhanj, District Latehar and Imteyaz Khan son of Azad Khan, resident of village Arahara, P.S. Herhanj, District Latehar who were allegedly brutally killed by the miscreants. Further directions were also sought for an inquiry by high level agency like CBI, CID, Vigilance, etc. However, the factum of the case presented essentially a claim for compensation to the next of the kin of the deceased. This apparently is a cause which comes within the category of personally aggrieved litigation.
Learned counsel for the petitioner, therefore, seeks permission to withdraw this writ petition, however with the liberty to the dependents of the deceased to raise their grievances in an appropriate proceeding before the appropriate forum/court of law.
Writ petition is, accordingly, dismissed as withdrawn. Dependents of the deceased may have such liberty to raise their grievances in an appropriate proceeding.
