Heard the learned counsel for the appellant and the learned counsel for the respondent State as well as the learned counsel for the O.P.No.2.
This appeal has been preferred against the order dated 09.09.2024 passed in M.C.A Case No.392 of 2024, in connection with Lohardaga SC/ST P.S.Case No.14 of 2024, whereby the regular bail of the appellant has been rejected, pending in the court of learned Additional Sessions Judge-I Cum Special Judge, SC/ST, Lohardaga.
The learned counsel appearing on behalf of appellant submits that the appellant and the respondent no.2 were in relationship and the appellant is in custody since 17.8.2024 and now he submits that since the marriage was not solemnized the present case has been lodged. He further submits that compromise has been arrived between the parties and it has been agreed that the appellant and the respondent no.2 will solemnize marriage.
The learned State counsel submits that the case has been made out.
Learned counsel for the respondent no.2 submits that compromise is there and both the parties are ready to solemnize the marriage and they are major. He submits that he has got no objection if the bail is granted to the appellant subject to that the appellant will solemnize marriage with the respondent no.2.
In reply, Mr. Nanda, the learned counsel appearing for the appellant submits that he has got instruction that the appellant will solemnize marriage with the respondent no.2.
In view of above and considering the compromise and further both are major and they are ready to solemnize marriage, I am inclined to grant bail to the appellant.
Hence, order dated 09.09.2024 passed in M.C.A Case No.392 of 2024, is set aside, and accordingly, appellant, above named, is directed to be released on bail, on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand), with two sureties of the like amount each, to the satisfaction of the learned Additional Sessions Judge-I Cum Special Judge, SC/ST, Lohardaga, in connection with Lohardaga SC/ST P.S.Case No.14 of 2024.
