The petitioner is seeking quashing of the allotment of cluster/posting list (Annexure P-3), whereby he has been posted in Govt. Senior Secondary School, Chhapera (Nuh).

Learned counsel for the petitioner refers to the letter dated 09.12.2019 (Annexure P-5), whereby Head Master, Govt. High School, Milkpur-II has written that one post of ABRC is lying vacant.

Grievance of the petitioner is that despite there being a vacant post in Govt. High School, Milkpur-II (Bhiwani), the petitioner has been posted in Mewat. In this regard, petitioner has served a legal notice dated 12.12.2019 (Annexure P-6) upon the respondent(s), but no action has been taken thereon till date.

On the asking of the Court, Mr. Harish Nain, AAG, Haryana, accepts notice on behalf of respondent-State.

At this stage, present petition is disposed of by giving direction to respondent No. 2 to look into the legal notice dated 12.12.2019 (Annexure P-6) and pass appropriate order in accordance with law, within a period of 15 days from the date of receipt of certified copy of this order. In case, legal notice is not decided, costs of Rs. 25,000/- shall be paid by respondent No. 2 to the petitioner.
