Judgment
When taken up, Smt. Thanuja Roshan George, learned counsel for the applicant submits that the applicant wants to withdraw the Original Application with liberty to file a fresh Original Application. When clarification was sought, she submits that even though the applicant was granted promotion, he was not relieved and he could not enjoy the fruits of promotion and thereafter he retired from service. Hence he wants to file a fresh Original Application seeking monetary reliefs vis-a vis the post to which he was proposed to be promoted.
Having heard the counsel on both sides, Original Application is permitted to be withdrawn with liberty to file a fresh Original Application. Accordingly, the Original Application is dismissed as withdrawn. No order as to costs.
