The learned I Additional District and Sessions Judge, Tirunelveli by his letter dated 05.05.2023 has sought two months time to dispose of the case in S.C. No.100 of 2019.
This Court by an order dated 14.03.2019 had directed the learned I Additional District and Sessions Judge, Tirunelveli to dispose of the case in S.C.No.100 of 2019 within a period of four months from the date of framing of charges. On 05.07.2022 trial commenced and on 11.10.2022 after receipt of case properties from the committal court 26 witnesses have been examined and further witnesses have to be examined. In the mean time further six months time was again requested by the learned Sessions Judge and this Court vide order dated 29.11.2022 has extended the time and the same was also expired on 04.05.2023.
The learned I Additional District and Sessions Judge, Tirunelveli in the letter stated that regular Judge was transferred and relieved from the post of I Additional District Judge, Tirunelveli on 10.03.2023 and the learned II Additional District Judge, Tirunelveli is holding full additional charge from 11.03.2023. All the witnesses were examined except the Investigation Officer , who expired. In the mean time petition under Section 311 of Cr.P.C was filed on 28.04.2023and now the case stand posted for examination of additional witnesses, hence he sought for two months time.
Considering the request made by the learned I Additional District and Sessions Judge, Tirunelveli and also considering the facts and circumstances of the case, time already granted by this Court to dispose the case in S.C. No.100 of 2019 is extended by another two months from the date of receipt of a copy of this order.
