This Criminal Original Petition is filed under Section 482 of the Code of Criminal Procedure seeking quashment of the FIR in Crime No.9 of 2022 on the file of the respondent No.1 police.
2.It is submitted by the learned counsel for the petitioners that the society, in which the petitioners are the members, is nothing to do with the new society, for which the respondent No.2 is the Chair Person of SPCA, Thanjavur. As per the bye- laws of SPCA, Thanjavur etc., which was formed very recently, the properties belonging to the society of the petitioners, have been shown as the properties of the new society (SPCA, Thanjavur).
3.The petitioners have filed W.P.(MD) No.11019 of 2023 to declare the action of the respondent No.4 in unilateral showing of the properties of the petitioners association as illegal. It is further submitted that the petitioners have not misappropriated any amounts of the society and that they have filed all the vouchers, account books, audited certificate etc.,
4.The learned Additional Public Prosecutor submits that most part of the investigation has already been completed including examination of 13 witnesses and submitted further that the prosecution has addressed many letters to the bank and the Collectorate to get some information in respect of the allegations levelled against the petitioners and soon after receiving the information, the police would file the charge sheet.
5.List on 30.08.2023 under the caption for final hearing. Until then, the respondent police are permitted to continue with the investigation and directed not to file the charge sheet.
