This Criminal Original Petition is filed under Section 482 of the Code of Criminal Procedure seeking quashment of CC.No.28 of 2023 on the file of the Additional Mahila Court, Srivilliputhur, Virudhunagar District.
2.It is submitted that the defacto complainant has left the matrimonial home in the year 2018 and filed a complaint on 04.05.2022 and if at all there is any harassment as alleged, she should have filed a complaint immediately after leaving the matrimonial home. It is submitted further that all the allegations made against the petitioners are false.
3.The learned Government Advocate (Crl.side), who has taken notice for the respondent No.1 police, has reported that charges have been framed and the case is posted for recording of evidence of L.W1 and L.W2 on 31.08.2023.
4.Issue notice to the respondent No.2 returnable by 18.09.2023. Private notice is also permitted. Until then, the presence of the petitioner No.2, who is aged about 69 years, alone is dispensed with before the trial Court. In the meanwhile, the trial Court is also directed to expedite the trial in CC.No.28 of 2023.
