I.A. No.468 of 2021
Heard.
The aforesaid I.A. has been filed by the petitioner under Section 389 of Cr.P.C. to release him on bail during pendency of the Criminal Revision.
The petitioner-Salman Pradhan @ Mallik has been convicted for commission of offence under Sections 354/323 of I.P.C. and sentenced to undergo Simple Imprisonment for one year under Section 354 I.P.C. and to undergo Simple
Imprisonment for three months under Section 323 of I.P.C. vide judgment and order dated 16.05.2015 passed by the learned S.D.J.M., Phulbani in G.R. Case No.19 of 2013 (TR No.649 of 2013) which was confirmed by the learned Sessions Judge, Phulbani vide judgment and order dated 12.12.2016 in Criminal Appeal No.16 of 2015.
It has been averred in the I.A. that the petitioner was through out on bail during trial as well as during the appellate stage and since last 15 days he is in custody. Learned counsel for the petitioner submits that the petitioner is in custody since 17.08.2021.
Considering the submissions of learned counsel for the petitioner, prayer for releasing the petitioner on bail is allowed.
Let the petitioner- Salman Pradhan @ Mallik be released on bail during pendency of the Criminal Revision by the learned trial court on such terms and conditions as he may deem fit and proper.
The I.A. is disposed of.
Urgent certified copy of this order be granted on proper application.
