Judgment
I.A. NO.1378 OF 2022
This is an application under Sec.389 Cr.P.C. filed by the Appellant for grant of bail. He has been convicted by learned 1st Addl. Sessions Judge, Khurda in S.T. Case No.46 of 2010 for commission of offences under Sections 302 of I.P.C. and other offences and sentenced to undergo R.I. for life along with fine.
Heard Mr. A.K. Moharana, learned counsel for the Appellant and Mr. K.K. Das, learned Additional Standing Counsel for State-Respondent.
It is submitted on behalf of the Appellant that he is inside custody since 12th September, 2009.
Upon hearing Mr. Das, learned ASC and going through the evidences, which are circumstantial in nature, as well as the period of detention of the Appellant inside custody, we are inclined to release the Appellant on bail pending appeal.
Accordingly it is directed to release the Appellant on bail pending appeal in connection with the aforesaid case on such terms and conditions as the learned 1st Addl. Sessions Judge, Khurda may deem just and proper.
The I.A. is disposed of.
