R.R. Prasad, J.—Learned counsel appearing for the petitioners is permitted to implead the Secretary, Bihar State Electricity Board, Patna as party-respondent No. 7 in this case.

Heard learned Counsel appearing for the petitioners and learned Counsel appearing for the Bihar State Electricity Board.

Learned Counsel appearing for the petitioners submits that one All Hasan Hawari while as working as Junior Accounts Clerk in the Electricity Board, he was made to retire on 12.10.1994 on the ground that the petitioner has committed forgery in the documents relating to date of birth and not only that a criminal case was also lodged against the petitioner in which the petitioner was convicted, which order was challenged before the appellate Court and the appellate Court set aside the order of conviction and sentence and acquitted him. Thereafter All Hasan Hawari made prayer for making payment of pension and other retiral dues, upon which he was asked to submit certain documents which was submitted before the respondent-authority way back in the year 2006 but still no decision in the matter of payment of pension and other retiral benefit has been taken though, in the meantime, All Hasan Hawari died and therefore, in his place, his heirs and legal representatives have been substituted.

In view of the submission, this writ application is disposed of with a direction to the petitioners to file a fresh representation before the Secretary, Bihar State Electricity Board, respondent No. 7 along with photo copies of this documents which had earlier been asked to be produced and the respondent No. 7 on receipt of the representation shall be taking decision in the matter of payment of pension and other retiral dues within a period of four weeks.

With the aforesaid direction/observation, this writ application is disposed of.
