The present application has been filed under Section 12A of IBC 2016 for withdrawal of the CIRP and main petition bearing No.176/Chd/Pb/2019. The settlement agreement has been placed on record as Annexure A3 dated 30.01.2023. It is stated by the learned counsel for the parties that they have compromised the matter and as per terms and conditions they may be permitted to withdraw the present petition as well as CIRP process. In view of the facts mentioned above IA No.595/2023 is allowed and disposed of accordingly and in view of this, CP(IB) No.176/Chd/Pb/2019 which is already admitted is also dismissed as withdrawn. As a consequence moratorium declared under Section 14 of the code comes to an end and the corporate debtor is discharged from the claims in lieu of the said petition and is free from the rigours of the Code and Regulations made thereunder. Henceforth, the IRP is discharged and the board of Directors is restored to its original position. Member (Technical) Member (Judicial)
