IA No.605/2023
The present application is filed under Section 12(A) read with Regulation 30-A under the Regulations with the CIRP for withdrawal of the CIRP process. No CoC has been constituted so far. The copy of Form-FA dated 27.02.2023 with copy of settlement and Board Resolution has been placed on record as Annexure A-4 with the application. Keeping in view the settlement agreement dated 21.02.2023 and statement made by learned counsel for the applicant, the present IA No.605/2023 is allowed and disposed of and in view of this, CP(IB) No.158/Chd/Pb/2019 is ordered to be dismissed as withdrawn. As a consequence moratorium declared under Section 14 of the code comes to an end and the corporate debtor is discharged from the claims in lieu of the said petition and is free from the rigours of the Code and Regulations made thereunder. Henceforth, the IRP is discharged and the board of Directors is restored to its original position.
