Judgment
ORDER
By Hon'ble Mrs. Justice Vijay Lakshmi, Member (J) We have joined this Division Bench online through video conferencing.
Shri P.K. Mishra, learned counsel for the applicant and Shri Chakrapani Vatsyayan, learned counsel for the respondents, both are present in Court.
Heard learned counsel for both the parties on admission and perused the record available with us in pdf.
At the very outset, learned counsel for the applicant submitted that the applicant is unmarried daughter of deceased Smt. Munni Devi, who died on 21.09.2021 and who was getting family pension. It is submitted that the applicant being an unmarried daughter, is legally entitled for family pension in place of her mother. It is submitted that she has already moved a representation dated 03.09.2020 (Annexure A-4) for such purpose. However, no order has been passed on her representation by the respondents till today.
It is submitted by learned counsel for the applicant that the applicant will be satisfied at this stage if the respondent concerned, who is the competent authority, is directed to decide the pending representation of the applicant dated 03.09.2020 (Annexure A-4) by passing a reasoned and speaking order, in accordance with law, in a time bound manner.
In view of the limited prayer made by the learned counsel for the applicant, no fruitful purpose will be served by keeping this matter pending and it is finally disposed of at the admission stage with the direction to the competent authority amongst the respondents, to decide the representation of the applicant dated 03.09.2020 (Annexure A-4) by passing a reasoned and speaking order, in accordance with law, within a period of two months from the date of receipt of a certified copy of this order. The order so passed shall be communicated to the applicant without delay.
It is made clear that we have not expressed any opinion on the merits of the case.
There is no order as to costs.
