The petitioners who were serving as ETT teachers under the

Department of Education, State of Punjab filed the instant writ petition

seeking a writ of mandamus directing the respondents to allow them to

change their option for grant of revised pay scale w.e.f. 01.11.2006 instead

of their earlier option exercised w.e.f. 01.01.2006 in terms of the Punjab

Civil Services (Revised Pay Scales) Rules, 2009.

The prayer was raised in view of the changed circumstances as

the respondent authorities had refixed their pay on account of which the

petitioners were suffering a financial loss as junior employees who had

exercised their option w.e.f. 01.11.2006 had started drawing a higher pay.

After issuance of notice of motion, a short reply on behalf of

respondent Nos.1 to 3 has been placed on record. Copy already stands

furnished to counsel opposite.

Para 2 of the written statement is in the following terms:-

"That in this regard it is submitted that same matter was involved in bunch of petitions including CWP No.18644 of 2015 titled as Gurmit Singh and others Vs. State of Punjab, which were allowed by this Hon''ble Court vide order dated 11.03.2016, the copy of this judgment is annexed herewith as Annexure P-12 by the petitioners. That in compliance with the order dated 11.03.2016 (Annexure P-12), the department has already allowed the petitioners to change their options for opting new pay scale w.e.f. 01.11.2006 instead of 01.01.2006 vide order dated 15.03.2017 after getting approval from the Department of Finance. A copy of this order dated 15.03.2017 is annexed herewith as Annexure R-1. Therefore, the petitioners have already been allowed to change their option for opting new pay scale w.e.f. 01.11.2006 instead of 01.01.2006. Hence, the grievances of the petitioners have already been redressed."

State has thus taken a stand whereby vide order dated

15.03.2017 (Annexure R-1) along with their written statement, the

petitioners have been permitted to change their options for opting new pay

scale w.e.f. 01.11.2006 instead of 01.01.2006.

Writ petition is accordingly disposed of as infructuous.
