The petitioner is an accused in a case registered u/s 414 I.P.C. It reveals from the written report that after receiving secret information, the place of occurrence was raided by the police and 3 tons of steam coal was recovered. On enquiry the name of the petitioner and other accused surfaced against illegal trade of coal.
It is submitted that nothing incriminating has been recovered from the possession of the petitioner and he has no concern with the open place where alleged coal was stored.
Learned Counsel, appearing for the State, has opposed the prayer. Considering the facts pointed out above, the petitioner, named above, is directed to surrender in the court below within three weeks from today and on such surrender, he shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri K. Pattadar, learned Judicial Magistrate, Dhanbad in connection with Nirsa (Kalubathan) P.S. Case No. 299 of 2012 (G.R. Case No. 4133 of 2011), subject to the conditions as laid down u/s 438(2) of the Code of Criminal Procedure.
