Learned Counsel for the Corporate Debtor brought to our notice that the order of admission is already passed against the same Corporate Debtor in the matter of i.e. Solartex India Pvt. Ltd. v/s. Honest Derivatives Pvt ltd. in CP(IB) No. 393/9/NCLT/AHM/2018 on 28.05.2020. In view of this, the proceeding stands disposed of with a liberty to approach IRP/RP in that proceeding for its claim.
In case, the order of admission set aside by any other Authority, then Operational Creditor is at liberty to revive the proceeding.
Accordingly, CP(IB) 367/9/NCLT/AHM/2019 is stands disposed of.
