The proceedings under Section 25(1) of the Societies Registration Act, 1860 (to be referred to as ‘the Act’) is going on before the Prescribed Authority/SDM, Kashipur, District Udham Singh Nagar in case No.02 of 2022 (Namita Gupta v. Gurdayal Singh). Mr. Gurdyal Singh, in the capacity of Secretary of petitioner’s Society, put-in-appearance before the Prescribed Authority and moved an application (Annexure No.12) and submitted that the dispute which is going on before the prescribed authority does not fall within the ambit of Section 25(1) of the Act.

The grievance of petitioner is that said application of petitioner is pending disposal and the same has not been decided by the Prescribed Authority.

Since the petitioner has participated in the proceedings of Misc. Case No.02 of 2022 (Namita Gupta v. Gurdayal Singh) by filing an application and objection thereto has also been filed, the question(s) to be decided in the matter is left open for the prescribed authority. There is no useful purpose to entertain this petition at this stage.

The petition is, accordingly, disposed of at this stage with the observation that the concerned Prescribed Authority shall decide the application of petitioner Society moved through its Secretary within a period of three months from the date of production of a certified copy of this order.

Pending application, if any, stands disposed of.
