Judgment

According to the petitioner, Deputy Registrar, Firms, Societies & Chits, Udham Singh Nagar has referred a dispute in respect of a society, which runs educational institution, namely, Arya Kanya Inter College, Rudrapur, Udham Singh Nagar; to the Prescribed Authority under Section 25 (1) of the Societies Registration Act, 1860.
By means of this writ petition, petitioner has sought following relief:-
(i) issue a writ, order or direction in the nature of mandamus, commanding and directing the respondents to decide the dispute under section 25(1) of the Societies Registration Act, 1860 referred to it by the Registrar, Firms, Societies & Chits, Udham Singh Nagar, vide letter dated 25.02.2021, within one month.
Having regard to the facts and circumstances of the case, the writ petition is disposed of with a direction to Prescribed Authority, Udham Singh Nagar to decide the dispute under Section 25 (1) of the Societies Registration Act, 1860, within a period of four months from the date of production of certified copy of this order. While taking decision, Prescribed Authority/Sub-Divisional Magistrate, Rudrapur, District Udham Singh Nagar shall hear all the stakeholders.
