This Civil Revision Petition has been filed aggrieved by the impugned Docket Order dated 06.04.2026 in I.A.No.529 of 2025 in O.S.No.126 of 2018 passed by the learned I Additional District and Sessions Judge-cum-Special Sessions Judge for Fast Tracking the Cases relating to Atrocities against Women, Vikarabad District, at Vikarabad.

Heard Mr. Vadeendra Joshi, learned counsel for the petitioner, and Mr. Kondaparthy Kiran Kumar, learned counsel for the respondents. Perused the material on record.

The petitioner, who is the plaintiff in O.S.No.126 of 2018, filed the said suit seeking declaration in respect of land admeasuring 9,680 square yards equivalent to Ac.2.00 guntas in Sy.No.80/part of Manneguda Village, Pudur Mandal, Vikarabad District. The petitioner had filed his chief-examination affidavit as PW1 and marked documents as Exs.A1 to A6 and the matter was posted for his cross-examination.

Learned counsel for the petitioner submits that the petitioner is aged about 73 years, filed I.A.No.529 of 2025 under Order XVIII Rule 4 read with Section 151 of the Code of Civil Procedure, 1908, before the trial Court seeking appointment of an Advocate Commissioner to record his cross-examination at his residence-at Hyderabad on the ground of old age and ill-health. The trial Court dismissed the said application observing that the petitioner had not produced any medical record to substantiate his alleged ill-health to show that he was unable to attend the Court for cross-examination.

Learned counsel for the petitioner further submits that the petitioner is now ready and willing to appear before the trial Court in person for his cross-examination. He further submits that the matter is posted to 11.09.2026 and that the petitioner undertakes to remain present on the said date.

In view of the above submission, the petitioner is directed to appear before the trial Court on 11.09.2026 for his cross-examination. On his appearance, the respondents shall proceed with and conclude the cross-examination of the petitioner on the said date, without fail.

Accordingly, the Civil Revision Petition is disposed of. There shall be no order as to costs.

As a sequel, miscellaneous applications pending, if any, in this Civil Revision Petition, shall stand closed.
