The petitioners are the elected representatives of the School Management Committee and were elected in the election conducted on 29.09.2026 to represent the respondent No.5-School.

It is submitted that the elected members were scheduled to take oath on 29.09.2026 at 02.00 P.M. However, the respondent No.5 addressed a letter to the respondent Nos.6 and 7, duly informing them that the respondent No.8 had issued oral instructions not to conduct the swearing-in ceremony of the School Management Committee on account of the alleged law and order issues.

The learned counsel appearing for the petitioners submits that the School Management Committee has nothing to do with any political activity and that the Committee is only intended to ensure proper implementation of the welfare schemes introduced for the benefit of the students. It is further submitted that the members of the Committee have nothing to do with the politics of any political party.

The learned Assistant Government Pleader appearing for the respondent Nos.1 and 2 submits that the petitioners may have to implead the State Project Director, Samagra Shiksha, Andhra Pradesh, as the elections were conducted pursuant to the proceedings issued by the State Project Director, Samagra Shiksha, Andhra Pradesh. The learned Assistant Government Pleader appearing for the respondent No.3 submits that the elections were conducted by the Headmaster of the School and that the District Collector has no role either in conducting the elections or in the subsequent swearing-in ceremony of the elected members. It is further submitted that the District Collector is the Chairperson of Samagra Shiksha at the District level.

The learned Assistant Government Pleader appearing for the respondent No.8 submits that the Headmaster of the School has sought deployment of police personnel to ensure the peaceful conduct of the swearing-in ceremony without any untoward incidents. It is further submitted that the respondent No.8 shall deploy the required police personnel to meet the requirement of the respondent No.5.

Recording the submissions made by the learned counsel appearing for the respective parties, the writ petition is disposed of, directing the respondent No.5 to complete the process of conducting the swearing-in ceremony of the elected School Management Committee. The respondent No.8 shall deploy adequate and required number of police personnel for facilitating the completion of the process initiated by the respondent No.5. The respondent No.8 shall also extend the required police protection as and when requested by the respondent No.5, so as to complete the swearing-in ceremony as expeditiously as possible.

Accordingly, the writ petition is disposed of. There shall be no order as to costs.

As a sequel, miscellaneous petitions pending, if any, shall stand closed.
