This contempt case is filed alleging that the respondents wilfully violated the order dated 28.10.2009 passed by this Court in W.P.No.23113 of 2009, whereunder respondent No.3 was directed not to seize the applicant’s weapon pending enquiry into the allegation levelled against him, and the applicant was directed to submit his explanation within a period of two weeks as the show cause notice has already been issued, and respondent No.3 was further directed to hold an enquiry on receipt of such explanation and pass appropriate orders thereon, within a period of six weeks.
There is no material on record to demonstrate that the respondents have not complied with the order passed in the above writ petition.
Learned counsel for the applicant submits that he has not received any fresh instructions from the client.
In view of the above, this Court is of the view that there is no point in keeping this contempt case pending.
Accordingly, the Contempt Case is disposed of reserving liberty to the applicant to move recall application, if cause of action still survives. Rule nisi issued against the respondents shall stand discharged. No costs. Miscellaneous applications shall stand closed.
